El presente trabajo estudia la nueva regulación que acontece a partir de la Ley 15/2005, de 8 de julio, de modificación del Código Civil, con respecto a la guarda y custodia, regularizando expresamente por primera vez la custodia compartida, tratando tanto los requisitos legales como los presupuestos materiales necesarios para la viabilidad de este modelo de custodia. Debido a la escasa regulación de esta materia en nuestro ordenamiento jurídico, los tribunales han sentado jurisprudencia, y aplicarán dicho modelo en aquellos supuestos en los que se proteja el interés superior del menor, que es el elemento esencial a valorar tras las rupturas matrimoniales.
The present paper studies the new regulation that has come about since the 15/2005 Act, July 8th, amending the Civil Code, with regard to custody and guardianship, expressly regulating shared custody for the first time, dealing with both the legal requirements and the material assumptions necessary for the viability of this model of custody. Due to the scant regulation of this matter in our legal system, the courts have established case law, and will apply this model in those cases in which the best interests of the child are protected, which is the essential element to be assessed after marital break-ups.
