In the USA, lawsuits have recently been filed against technological giants in which the demerger or break-up of the company is requested. On the other hand, both in that country and in Europe there is talk of the need for the Authorities to have stronger remedies to fight against the abuses of the big giants; between them, the possibility of breaking them up. In this paper, the risks of this measure are exposed and the different ways of configuring it, analyzing in each one if the risks materialize or not; or on the contrary, there is an adequate weighting of the interests at stake.
En USA se han interpuesto recientemente demandas contra gigantes tecnológicos en las que se solicita la desconcentración o separación de la empresa. Por otra parte, tanto en ese país como en Europa se habla de la necesidad de que las Autoridades cuenten con remedios más enérgicos para luchar contra los abusos de los grandes gigantes tecnológicos; entre ellos, la posibilidad de separarlos. En el presente trabajo se exponen los riesgos de esa medida y se plantean las distintas maneras de configurarla analizando en cada una si se materializan o si, por el contrario, hay una adecuada ponderación de los intereses en juego.
