El justiprecio en la expropiación forzosa

Abstract

El objetivo de este trabajo es analizar uno de los componentes esenciales del procedimiento de la expropiación forzosa, el justiprecio, que será aquella indemnización que tendrá que abonar el sujeto beneficiario de los bienes o derechos que van a ser objeto de expropiación. A lo largo de este trabajo, trataré de explicar en qué consiste el justiprecio, cuáles serán los criterios que se utilicen para la valoración de éste, el momento en que debe efectuarse el pago y las formas de pago. Además, trataré de analizar algunos problemas que surgen en torno a la determinación del justiprecio, ya sean los problemas que surgen por los desajustes en el tiempo que dura el proceso o aquellos originados por el hecho de que las cuantías no cubran la integridad del sacrificio del expropiado.
