En el presente trabajo vamos a encontrar un análisis global de la eutanasia basado en clarificar el concepto y en la evolución que ha sufrido esta figura en España. El objetivo es analizar las principales polémicas que suscita la eutanasia, para acabar estudiando la Ley Orgánica reguladora de la eutanasia, la cual despenaliza la eutanasia activa directa. Se recogerá la compatibilidad de la eutanasia con la Constitución y su relación con los diferentes derechos fundamentales. Así mismo, se expondrá la forma en la que se ha conseguido regular la eutanasia a través de la reforma del artículo 143 del Código Penal.
In this paper we will find a global analysis of euthanasia based on clarifying the concept and the evolution that this figure has undergone in Spain. The aim is to analyze the main controversies raised by euthanasia, to finish by studying the Organic Law regulating euthanasia, which decriminalizes direct active euthanasia. The compatibility of euthanasia with the Constitution and its relationship with the different fundamental rights will be discussed. Likewise, the way in which euthanasia has been regulated through the reform of article 143 of the Penal Code will be explained.
