La Convención Internacional sobre los derechos de las personas con discapacidad implanta un modelo basado en el pleno respeto de los derechos de las personas con discapacidad. Esta Convención es ratificada por España en 2008, y como indica la Convención tiene la obligación de adaptar su Derecho interno a los parámetros establecidos en la misma. Para ello España adopta la Ley 8/2021, de 2 de junio por la que se reforma la legislación civil y procesal. Pero, ¿realmente esta ley adapta el Derecho interno a la Convención? ¿O ya se encontraba en buena medida adaptado a la misma? ¿Qué nivel de seguridad jurídica aporta en el tratamiento de las personas con discapacidad? ¿Constituye un avance respecto a la legislación anterior?
Convention on the Rights of Persons with Disabilities meant the implantation of a model based on full respect for the rights of people with disabilities. This Convention was ratified by Spain in 2008, and as it is indicated, the Convention has the obligation to adapt its internal law to the parameters established in it. As result, law 8/2021, of 2nd of June, was adopted, by which law the civil and procedural legislation were reformed. However, Does this law really adapt domestic law to the Convention? Or was it already adapted to it? What level of legal certainty does it provide in the treatment of people with disabilities? Is it an advance in regard to the previous legislation?
