La enajenación de la unidad productiva en el procedimiento concursal ha ido evolucionando hasta convertirse en la solución ideal para las situaciones de insolvencia. El régimen de especialidades previsto en la normativa presente permite su utilización en cualquier estado del concurso. Esta operación alcanza el fin mixto, solutorio-conservativo, de la normativa concursal pues se consigue salvaguardar el tejido empresarial y al mismo tiempo satisfacer el interés económico de los acreedores, siendo por tanto un mecanismo fomentado por el legislador. A través de este trabajo se realiza un estudio sobre la importancia de la transmisión de la unidad productiva en el concurso y la evolución de su régimen legal.
The sale of the productive unit in the bankruptcy evolved to become the ideal solution for insolvency situations. The specialities set of rules allow its use in any stage of the process. This operation achieves the mixed purpose, solutory-conservative, of the rules since it manages to safeguard business network and at the same time, satisfy the economic interest of the creditors, being therefore a mechanism promoted by the legislator. Through this work, a study is carried out on the importance of the transmission of the productive unit in the state of insolvency and the evolution of its legal regime.
