El delito de aproximación a menores con fines sexuales a través de las TICs o "child grooming"

Abstract

El presente trabajo aborda la inclusión de un novedoso tipo penal contra la libertad e indemnidad sexual del menor de dieciséis años, desarrollado en el artículo 183. ter del Código Penal. La figura delictiva tratada es el denominado “Online Child Grooming”, término extendido en el ámbito internacional y que ha llegado a nuestro ordenamiento a raíz de la reciente reforma constituida a través de la LO 1/2015, de 30 de marzo. Analizaremos la necesidad de adaptación a las nuevas demandas sociales y adecuación de nuestra legislación a los compromisos internacionales, de los que España es parte, concretamente la directiva 2011/93/UE. Posteriormente, analizaremos de manera detallada su estructura típica, así como las diferentes complejidades planteadas en su configuración y las numerosas posturas doctrinales existentes. Todos los conceptos relativos a la prevención y protección de las víctimas y las medidas necesarias para evitar la práctica de la conducta delictiva será el hilo conductor y objeto de estudio a lo largo de todo el trabajo.

The present work deals with the inclusion of a new penal type against the freedom and sexual indemnity of the minor of sixteen years of age, developed in Article 183. ter of the Penal Code. The criminal figure dealt with is the so-called "Online Child Grooming", a term extended internationally and that has come to our legal system because of the recent reform constituted through LO 1/2015, of March 30. We will analyze the need to adapt to new social demands and adapt our legislation to international commitments, of which Spain is a party, specifically directive 2011/93/UE. Subsequently, we will analyze in detail its typical structure, as well as the different complexities raised in its configuration and the numerous existing doctrinal positions. All the concepts related to the prevention and protection of victims and the necessary measures to avoid the practice of criminal behavior will be the guiding thread and object of study throughout the entire work.
