En el presente trabajo se realiza un estudio exhaustivo de uno de los
requisitos imprescindible para el inicio de la ejecución, como es el título
ejecutivo, tal y como revela el aforismo romano nulla executio sin titolo . Este
instrumento como acto jurídico determinado, deberá de reunir una serie de
características propias ara su eficacia y validez.
Así las cosas, además de estudiar su concepto y naturaleza jurídica, en
este trabajo se abordarán pormenorizadamente todas las clases de títulos
ejecutivos tanto judiciales como extrajudiciales, así como el título ejecutivo
extranjero, haciendo especial hincapié en el titulo jurídico europeo. Por último
será de sumo interés exponer los requisitos para la ejecución del aludo
extranjero o para la homologación y ejecución de las resoluciones canónicas.
In the present work an exhaustive study of one of the essential
requirements for the beginning of the execution is carried out, such as the
executive title, as revealed by the Roman aphorism nulla executio sin titolo .
This instrument, as a specific legal act, must have a series of characteristics of
its own for its effectiveness and validity.
Thus, in addition to studying its concept and legal nature, all classes of
judicial and extrajudicial enforceable titles, as well as the foreign enforceable
title, will be addressed in detail, with special emphasis on the European legal
title. Finally, it will be of great interest to set out the requirements for the
enforcement of the foreign award or for the approval and enforcement of
canonical decisions.
