La desheredación testamentaria y la indignidad sucesoria

Abstract

El presente trabajo tiene por objeto el conocimiento y el análisis de los aspectos más importantes de la desheredación testamentaria y la indignidad sucesoria. Pretende explicar la repercusión y alcance que cada una de estas instituciones tiene en el marco del Derecho de sucesiones. Para ello, en el transcurso de las siguientes líneas se va a llevar a cabo un amplio recorrido bibliográfico en el que se van a examinar las obras de quienes más significativamente han estudiado, y estudian, estas dos figuras jurídicas. Además, junto con el estudio del derecho positivo, se va a realizar una labor de inspección jurisprudencial en la que especialmente se pondrán de relieve las sentencias del Tribunal Supremo de 3 de junio de 2014 y de 30 de enero de 2015

The aim of this work is to explore and analyze the most important aspects of testamentary disinheritance and unworthiness to inherit. It seeks to explain the impact and scope that each of these legal institutions has in the field of inheritance law. To this end, a comprehensive bibliographic review will be carried out in the following lines, examining the works of those who have studied these two legal figures most significantly. In addition, along with the study of positive law, a jurisprudential inspection will be conducted, in which the judgments of the Supreme Court of June 3, 2014 and January 30, 2015, will be highlighted.
