La prueba testifical en el proceso civil. Estudios jurisprudencial

Abstract

La prueba testifical es un medio de prueba de naturaleza personal que consiste en las diferentes declaraciones que personas ajenas al proceso puedan llevar a cabo ante la autoridad judicial durante el desarrollo del juicio. De este modo, los denominados “testigos”, proporcionan información acerca de los hechos que ellos mismos han presenciado o de los cuales tienen conocimiento, lo cual contribuye al esclarecimiento de los hechos controvertidos referidos al objeto litigioso del proceso en cuestión. A lo largo de este trabajo se va a proceder a realizar un análisis de este medio probatorio en su conjunto, haciendo alusión tanto a su objeto, como a su finalidad, y sin olvidar las dificultades que supone el empleo de las declaraciones testificales con el fin de obtener la certeza de los hechos de un determinado litigio. Se prestará especial atención a la interpretación jurisprudencial de este medio de prueba en el proceso civil.

Witness evidence is a means of proof of a personal nature consisting of the different declarations that persons outside the process may make before the judicial authority during the development of the trial. In this way, the supposed ‘witnesses’ provide information about the facts that they themselves have witnessed or of which they have knowledge. This contributes to the clarification of the disputed facts relating to the subject matter of the litigation in question. Throughout the paper, this means of evidence will be analysed as a whole, referring both to its object and purpose, as well as the difficulties involved in the use of testimonial statements in order to obtain certainty of the facts of a given litigation. Particular focus will be given to the jurisprudential interpretation of this means of evidence in the civil process.
