El objetivo de este TFG es analizar la figura de las devoluciones en caliente,
introducidas en el ordenamiento jurídico español de extranjería como un
régimen especial para los territorios de Ceuta y Melilla bajo la terminología de
“rechazos en frontera”.
Este trabajo se centrará en examinar la legalidad internacional y la
constitucionalidad de las devoluciones en caliente, analizando la problemática
relativa a la vulneración por estas prácticas de derechos humanos y
fundamentales de los extranjeros, y estudiando la jurisprudencia del Tribunal
Europeo de Derechos Humanos y del Tribunal Constitucional español.
The aim of this TFG is to analyse the figure of hot returns, introduced in the
Spanish legislation on aliens as an special regime for the territories of Ceuta
and Melilla under the terminology of “cross-border push-backs”.
This paper will focus on examining the international legality and constitutionality
of hot returns, analysing the problems related to the violation of human and
fundamental rights of aliens by these practices, and studying the jurisprudence
of the European Court of Human Rights and the Spanish Constitutional Court.
