El derecho de reversión en la expropiación forzosa

Abstract

Mediante el presente trabajo “El derecho de Reversión en la Expropiación forzosa”, pretendo mostrar un análisis detallado de la ultima garantía que se ofrece al expropiado frente a la actividad expropiatoria de la administración pública, el Derecho de Reversión. A lo largo del trabajo se irán abordando las diferentes situaciones en las que la reversión esté motivada, partiendo siempre de la legislación, así como de la causa expropiandi. Se mostrará el concepto positivo de esta figura incluyendo el justiprecio, del mismo modo que el negativo y sus respectivos cambios a lo largo del tiempo, los procedimientos y plazos para ejercitar las acciones y por último, el trabajo finalizará con una serie de conclusiones. Todo ello estará acompañado de ejemplos jurisprudenciales que ayudarán a comprender mejor la materia. El motivo de la elección de este tema para realizar mi trabajo de fin de grado tiene su fundamento en el hecho de querer aprender a la par que exponer una materia tan interesante y compleja como es la reversión a la privación de la propiedad privada o derechos o intereses legítimos que por razones de utilidad pública o interés social han sido expropiados.

Through this work “The right of Reversion in Forced Expropriation”, I intend to show a detailed analysis of the last guarantee offered to the expropriated person against the expropriation activity of the public administration, the Right of Reversion. Throughout the work, the different situations in which the reversion is motivated will be addressed, always starting from the legislation, as well as the expropiandi cause. The positive concept of this figure will be shown including the fair price, in the same way as the negative one, and its respective changes over time, the procedures and deadlines to exercise the actions and finally, the work will end with a series of conclusions. All of this will be accompanied by jurisprudential examples that will help to better understand the matter. The reason for choosing this topic to carry out my final degree project is based on the fact of wanting to learn while exposing a subject as interesting and complex as the reversion to the deprivation of private property or rights or legitimate interests that have been expropriated for reasons of public utility or social interest.
