La Ley Orgánica 10/2022, de 6 de septiembre, de Garantía Integral de la Libertad Sexual, ha
significado un antes y un después en la regulación de los delitos sexuales en nuestro país. La
reforma acaecida por la entrada en vigor de esta ley no ha dejado indiferente a nadie, lo que
permite encontrarnos tanto posiciones defensoras como críticas de la nueva regulación.
Esencialmente, la nueva ley ha producido dos modificaciones fundamentales frente a la
legislación anterior: la unificación de los delitos de abuso y agresión sexual en uno solo con
el nombre del último y una nueva definición o representación del consentimiento dentro del
marco de los delitos contra la libertad sexual. Asimismo, las mayores críticas recibidas por la
LO 10/2022, de 6 de septiembre, se deben esencialmente a los problemas de retroactividad
que generó, al provocar la rebaja de muchas condenas y salida de la cárcel de numerosas
personas condenadas por delitos contra la libertad sexual

many sentences and the release from prison of numerous people convicted of crimes against
sexual freedom.
