Estudio de la custodia compartida

Abstract

El propósito de este trabajo es examinar la custodia compartida en el contexto español. Nos enfocaremos en su evolución a nivel nacional, así como en la regulación específica de algunas Comunidades Autónomas (CCAA). Dada la limitada legislación al respecto, analizaremos los criterios y requisitos que los tribunales han establecido para determinar el régimen de custodia compartida. También abordaremos los posibles problemas que pueden surgir durante la implementación de este régimen, así como otros aspectos asociados con la custodia compartida. Por último, llevaré a cabo un breve análisis comparativo de la situación de la custodia compartida en el resto de Europa, contrastándola con el régimen español.

The purpose of this paper is to examine shared custody in the Spanish context. We will focus on its evolution at the national level, as well as on the specific regulation of some Autonomous Communities (CCAA). Given the limited legislation in this regard, we will analyze the criteria and requirements that the courts have established to determine the joint custody regime. We will also address the potential issues that may arise during the implementation of this regime, as well as other aspects associated with joint custody. Finally, I will carry out a brief comparative analysis of the situation of shared custody in the rest of Europe, contrasting it with the Spanish regime.
