La reinserción social de la delincuencia violenta

Abstract

De acuerdo con el artículo 25.2 de la Constitución Española, las penas privativas de libertad tienen como fin primordial la reeducación y la reinserción social. Este trabajo se va a desarrollar en base a este mandato constitucional, prestando especial atención a la reinserción social de un tipo de delincuencia que ha suscitado gran inquietud en la sociedad, esta es, la delincuencia violenta. Se procederá analizando el origen de la reinserción, su regulación en los textos normativos, el tratamiento penitenciario aplicado para alcanzar este objetivo, se evaluará la reincidencia de los internos y, finalmente, se abordará la pena de prisión permanente revisable en relación con este tema

According to article 25.2 of the Spanish Constitution, custodial sentences primarily aim at reeducation and social reintegration. This work will be developed based on this constitutional mandate, with special attention to the social reintegration of a type of delinquency that has caused great concern in society, namely violent delinquency. The origins of reintegration, its regulation in normative texts, and the penitentiary treatment applied to achieve this goal will be analyzed. The recidivism of the inmates will be evaluated, and finally, the issue of the reviewable permanent prison sentence will be addressed in relation to this topic
