La custodia compartida y el distanciamiento de los domicilios

Abstract

Este dictamen jurídico expone un caso sobre un cliente que vino a nuestro despacho a pedirnos ayuda sobre derecho de familia, y en el cual hemos expuesto su situación de vulnerabilidad, ya que su ex pareja se trasladó a otra CCAA con sus hijas menores y tras mantener durante un tiempo una custodia compartida, ésta deja de entregarle a sus hijas para que puedan pasar con él el tiempo que le corresponde. Y en este dictamen nos hemos centrado en estudiar la custodia compartida y el régimen de visitas y su legislación correspondiente, así como la jurisprudencia aplicable a su situación y los criterios que llevan a cabo los Tribunales en situaciones similares para la atribución de la custodia compartida.

This legal opinion presents a case about a client who came to our office to ask us for help with family law, and in which we have explained his vulnerable situation, since his ex-partner moved to another Autonomous Community with his minor daughters and after maintaining shared custody for a while, she stops giving him his daughters so that they can spend the time that corresponds to him. And in this opinion we have focused on studying shared custody and the visitation regime and its applicable legislation, as well as the jurisprudence applicable to his situation and the criteria that the Courts carry out in similar situations for the attribution of shared custody.
