Abstract

Los medios de prueba audiovisuales y telemáticos se consideran pruebas de naturaleza real y se insertan dentro del concepto más amplio de prueba electrónica o digital en cuanto incorporan las nuevas tecnologías. La normativa distingue dos tipos principales dentro de esta categoría. Por un lado, los dispositivos de filmación, grabación y similares. Por otro lado, aquellos instrumentos que permiten almacenar, acceder o reproducir datos que resulten relevantes para el proceso judicial. En el primer caso, se propone como medio probatorio la presentación ante el tribunal de imágenes, sonidos o palabras captadas mediante dichos dispositivos.
