La discriminacion de la mujer en el aceso a la disolucion del matrimonio: el repudio islamico y su eficacia civil.

Abstract

En el presente trabajo, trataremos del creciente fenómeno del repudio islámico en España como consecuencia de la diversidad cultural y religiosa que viene dándose en las dos últimas décadas. Nos centraremos en la desigualdad que se produce entre el hombre y la mujer, en la institución del matrimonio islámico y posterior repudio, en su caso, todo ello consecuencia de los privilegios reconocidos a la figura del varón “esposo” por el derecho islámico, contraviniendo las cláusulas de orden público y derechos fundamentales establecidos en la cultura / derecho occidental. Haremos hincapié en el tema central del trabajo que es la institución del repudio y las diferentes clases de éste, así como a la posibilidad del hombre de poner fin o disolver su matrimonio de manera unilateral o bilateral, dejado ver ese poder de superioridad que tiene el varón frente a la mujer y de todos los privilegios de que goza durante la vigencia de su matrimonio y la desprotección de la esposa. Por último, haremos mención también al posible reconocimiento de eficacia civil de esta institución del derecho islámico que es el repudio en nuestro sistema jurídico, a través del análisis de algunos pronunciamientos judiciales.

In this paper, we will deal with the growing phenomenon of Islamic repudiation in Spain as a consequence of the cultural diversity that has been occurring for some years now. We will focus on the inequality that occurs between men and women, in the institution of Islamic marriage and subsequent repudiation, if any, all as a result of the privileges granted to the figure of the male “husband” by Islamic law, contravening the clauses of public order and fundamental rights established in Western culture / law. We will emphasize the central theme of the work which is the institution of repudiation and the different types of this, as well as the possibility of the man to end or dissolve his marriage unilaterally or bilaterally, letting us see the power of superiority that the man has over the woman and all the privileges he enjoys during the term of his marriage and the lack of protection of the wife. Finally, we will also mention the possible recognition of civil effectiveness this institution Islamic law that is the repudiation in our legal system.
