La trata de personas como una violación de los derechos humanos

Abstract

La trata de personas representa una de las formas más graves de vulneración de los derechos humanos en la actualidad. Para comprender el alcance de este delito es necesario abordar el marco normativo que lo regula, tanto a nivel internacional como en el contexto jurídico español, así como las disposiciones legales que amparan a las víctimas. También es fundamental realizar un análisis de los factores históricos y estructurales que originan este fenómeno, cuyos orígenes se remontan a prácticas esclavistas que, aún hoy, persisten bajo formas modernas de explotación. El trabajo examina además las motivaciones que justifican estos crímenes, asi como el modus operandi de las redes criminales involucradas en la trata, con el fin de comprender este delito que continúa desarrollándose a gran escala en todo el mundo. Se presta especial atención a las principales finalidades de explotación, ya que no debemos perder de vista que la trata es un medio para alcanzar un fin. La única manera de conocer verdaderamente esta realidad es a través de los testimonios de las propias víctimas, los cuales acompañan cada una de las formas de explotación tratadas y reflejan la dureza de su experiencia. Para seguir desarrollando este tema, se estudia también el perfil de las víctimas, asi como el principio de no punición, orientado a garantizar que las víctimas no sean criminalizadas por delitos cometidos bajo coacción o circunstancias que deriven de su situación como afectados. Por último, se analizan las medidas de prevención y detección, además de medidas de apoyo tanto a nivel nacional como internación, con el objetivo de ofrecer una respuesta integral y eficaz frente a esta grave violación de los derechos humanos.

Humman trafficking is one of the most serious forms of human rights violations in the actual world. To understand the importance of this crime, it is essential to examine the legal framework that regulates it, both, at an international level and within the Spanish legal system, as well as the provisions aimed at protecting victims. It is also crucial to analyze the historical and structural factors that give rise to this phenomenon, whose roots trace back to slavery practices that, even today, persist under modern forms of exploitation. This study also explores the motivations that drive these crimes, along with the modus operandi of the criminal networks involved in trafficking, in order to understand why this crime continues to develop on such a large scale globally. Special attention is given to the main purposes of exploitation, as trafficking is a means to an end. The only way to fully know the reality we are facing is through victims’ testimonies, which are included in each section on the different forms of exploitation and serve to illustrate the harsh reality endured by those affected. In addition, the profile of the victims and the principle of non-punishment are examined, with the aim of ensuring that victims are not criminalized for offences committed under coercion or as a result of their trafficking situation. Finally, the study analyzes prevention and detection measures, as well as support mechanisms at both, national and international levels, with the objective of offering a comprehensive and effective response to this serious human rights violation.
