Posibilidades de aplicar el enfoque de actos de habla a ejercitativos en contextos informales

Abstract

Desde que Catharine MacKinnon sostuviera que la pornografía subordina y silencia a las mujeres, el debate en torno a los límites de la libertad de expresión y la legitimidad de censurar contenidos pornográficos ha sido ampliamente desarrollado por los liberales y las teóricas feministas. Por otro lado, el hecho de que la pornografía haya sido considerada un discurso ha suscitado el interés de las filósofas del lenguaje, y más específicamente de las teóricas de los actos de habla al ser considerado un discurso que hace algo: subordinar y silenciar. En este trabajo se va a negar la tesis de que la pornografía es un discurso y una expresión artística, lo que permite retirar el amparo de la libertad de expresión a los pornógrafos y se va a atribuir a la pornografía el estatus ontológico de hechos descritos por determinados enunciados.

Since Catharine MacKinnon argued that pornography can subordinate and silence women the debate around the limits of free speech and the legitimacy of censoring pornographic content has been developed by liberals and feminist theorists. On the other hand, the fact that pornography has been considered as speech has sparked the interest of philosophers of language and more specifically, the interest of speech act theorists as it is considered an speech that does something: subordinate and silence. In this work, the thesis that pornography is a kind of speech or an artistic expression is going to be denied, which allows to withdraw the protection of free speech right to pornographers. The ontological status that will be attributed to the facts filmed in pornography is the status of described facts.
