Medidas de investigación tecnológica en el nuevo anteproyecto de ley de enjuiciamiento criminal

Abstract

Este trabajo tiene por finalidad analizarlas medidas de investigación tecnológica en el nuevo anteproyecto de ley de enjuiciamiento criminal (2020), así como compararlas con las medidas de investigación tecnológica recogidas en la vigente Ley de enjuiciamiento Criminal (LECrim). De este modo obtendremos una visión general de las modificaciones y mejoras que haya podido introducir el legislador en el anteproyecto con el fin de modernizar y actualizar las mencionadas medidas para adaptarlas a la nueva realidad, siempre cambiante de la lucha contra la criminalidad, dentro del respeto a los derechos fundamentales y teniendo como inspiración los principios rectores de especialidad, excepcionalidad, necesidad, idoneidad y proporcionalidad.

The aim of this paper is to analyse the technological investigative measures in the new draft criminal procedure act (2020) as well as to compare them with the technological investigative measures included in the current Criminal Procedure Act (LECrim). In this way we will obtain an overview of the modifications and improvements that the legislator may have introduced in the draft text in order to modernize and update the aforementioned measures to adapt them to the new, ever-changing reality of the fight against crime, while respecting fundamental rights and taking as inspiration the guiding principles of specialty, exceptionality, necessity, suitability and proportionality.
