Tratamiento y resocialización penitenciaria

Abstract

El presente trabajo versa sobre las medidas e instrumentos penitenciarios que buscan conseguir el fin último de la pena, la reeducación y reinserción social, tales como los diversos programas tratamentales, el acceso a la educación o formación profesional y los permisos de salida, entre otros. Alcanzable siempre y cuando se atienda a las necesidades del interno. Velando, en todo momento, por el respeto de los derechos fundamentales y humanos recogidos en el ordenamiento jurídico, así como los límites surgidos de la propia legislación reguladora del tratamiento penitenciario. A mayores se resalta la figura de la prisión permanente revisable, objeto de últimas discusiones en el seno político del país, centrándose en la a vertiente del tratamiento del individuo en este tipo de condenas.

The present study deals with penal measures and instruments which seek to obtain the final resolution of the sentence, re-education and social reintegration, such as the various treatment programs, access to education or professional training, and the release authorizations, among others. To that effect, it is essential to consider the intern needs and to act in accordance with the fundamental and human rights contained in the legal system at all times, together with the limitations derived from the regulatory legislation of prison treatment. In addition, the figure of revocable life imprisonment is emphasized as it has been the subject of recent discussions in the political heart of the country. The debate is focused on the individual's treatment aspect in this type of sentence.
