La indignidad sucesoria y la desheredación

Abstract

El presente Trabajo de Fin de Grado tiene como objetivo analizar las figuras de la indignidad sucesoria y la desheredación desde su nacimiento hasta la actualidad. A lo largo del documento se realiza un recorrido a través del Derecho Romano, el Fuero Real, las Siete Partidas y los distintos proyectos de Código Civil llegando hasta el Código Civil vigente. Partiendo de este análisis se estudia la jurisprudencia y los debates doctrinales que alrededor de la indignidad y la desheredación existen, así como sus diferencias y la actual postura del Tribunal Supremo respecto a estas. Todos estos apartados analizados sirven de base para plantear la cuestión acerca de la necesaria modernización de las causas de desheredación en el Código Civil español teniendo en cuenta la perspectiva del abandono afectivo y el maltrato psicológico.

The aim of this Final Degree Project is to analyse the figures of inheritance unworthiness and disinheritance from their birth to the present day. Throughout the document, a journey is made through Roman Law, the Fuero Real, the Siete Partidas and the different drafts of the Civil Code up to the current Civil Code. Based on this analysis, the jurisprudence and doctrinal debates surrounding indignity and disinheritance are studied, as well as their differences and the current position of the Supreme Court with regard to them. All these sections analysed serve as a basis to raise the question of the necessary modernisation of the causes of disinheritance in the Spanish Civil Code, taking into account the perspective of affective abandonment and psychological abuse.
