En el presente Trabajo de Fin de Grado se analizará la figura del Juez instructor en nuestro país y su importancia en el sistema judicial actual. Se llevará a cabo una comparación con la figura del Ministerio Fiscal, concretamente nos centraremos en el papel que desempeña durante la investigación. De este modo se obtendrá un conocimiento profundo sobre ambas figuras que, junto con un análisis de la fase de instrucción en el proceso penal español, conducirá al objetivo de este trabajo que consiste en realizar una reflexión sobre si resulta apropiado atribuir la investigación penal al Ministerio Fiscal, tal y como pretendían los múltiples intentos de reforma de la Ley de Enjuiciamiento Criminal, y tal y como se pretende en la actualidad.
This Final Degree Project will analyse the figure of the Investigating Judge in our country and his importance in the current judicial system. A comparison will be made with the figure of the Crown Prosecution Service, specifically focusing on the role it plays during the investigation. This will provide an in-depth knowledge of both figures which, together with an analysis of the investigation phase in Spanish criminal proceedings, will lead us to the objective of this work, which is to reflect on whether it is appropriate to attribute the criminal investigation to the Crown Prosecution Service, as was intended in the multiple attempts to reform the Criminal Procedure Law, and as is currently intended.
